Terms of a settlement between Disneyland and a Magic Key Holder who filed a class-action lawsuit in 2021 have now been revealed.
The lawsuit alleged that Disney misled Magic Key Pass Holders with expectations of unblocked dates while still limiting capacity and restricting reservations. The lawsuit now has a pending settlement and the details have now been released.
Terms of the settlement established that $9.5 million will be split among the approximately 103,435 pass holders that held the specific impacted pass type.

Who Will Get Paid In This Magic Key Settlement?
This lawsuit is specifically related to the now-discontinued “Dream” key Magic Key Pass. This pass included the benefit of being able to make theme park reservations on all 365 days of the year. Though this was the expectation, dates were frequently unavailable to reserve.
The Magic Key Program launched in 2021 as the replacement for the popular Disneyland Annual Pass Program. Unlike the Annual Pass Program which provided unfettered access to Disneyland Park and Disney California Adventure Park on non-block out dates, the Magic Key Program restricts access with required park reservations in addition to calendar block out dates.
The “Dream” key pass has now been replaced with the “Inspire” key pass. There is no longer a Magic Key Pass that grants access to visit on all calendar dates of the year. Now even the top tier pass has the two weeks around Christmas blocked out completely.
A statement from Disneyland officials released to CNN stated that they “are satisfied that this matter has been resolved.”
Sales of all tiers of the Disneyland Magic Key Pass program are now been paused. The sales of the top-tier Inspire key were paused after the news of the settlement. We will keep you up to date on the FREE Mickey Visit newsletter when new information is released.

How Much is Settlement in Magic Key Lawsuit?
The released court documents state that Magic Key Pass Holders would be paid approximately $67.41 per person. No additional registration is required. Any eligible Magic Key Pass Holders would receive payment and an email would be sent at a later date. Though the agreement has been reached, the settlement will now require preliminary approval from a judge before final deal sign-off an expert told CNN. That same expert shared that the settlement could take a couple of months to be processed.

There may also be a second round of payments. The settlement includes that “after the initial distribution of payments, if the amount remaining in the Settlement Fund (after any unredeemed checks expire, and after the amounts of notice, administration, Class Counsel’s fees, and a service award of the class representative) is greater than $10.00 per Settlement Class Member, each Settlement Class Member will receive a second pro rata payment.”
