Some Disney adults would argue it’s just part of the experience to get your foot stuck in the trolley tracks on Main Street, U.S.A., as you’re walking into Magic Kingdom.
One woman disagrees as she is suing Walt Disney World after she tripped and fell over the trolley tracks in Magic Kingdom. At Mickey Visit, we report on all the recent Disney news, like construction updates in Magic Kingdom and the new paint job coming to Cinderella Castle.

Woman Suing Disney After Tripping on Trolley Tracks
Rhonda Smith of Frankfort, Kentucky, has filed a lawsuit for $50,000 against Walt Disney Parks and Resorts after she tripped and fell on the trolley tracks in Magic Kingdom. The lawsuit was filed on December 22, 2025, in the Florida Circuit Court in Orange County, Florida. Smith claims that the trolley tracks do not “adequately have marked steel rails and flangeways near a castle attraction,” which caused her to trip and fall, resulting in “permanent injuries and substantial medical expenses.”

The lawsuit states that Smith tripped on the embedded track for a “train or trolley” on Main Street, U.S.A., on October 24, 2025, at approximately 5:00 PM. According to the complaint, the pedestrian walkway in this area contains steel rails and flangeways for the trolley that create “changes in level, edges, and gaps where the rail meets the surrounding ground.”
The lawsuit alleges that the section where the trolley tracks are embedded did not have sufficient safety precautions in place, such as warning signage, cones, stanchions, guardrails, or similar protective measures, particularly given nighttime visibility and increased crowd density during parades.
According to the complaint filed by Smith, Disney “breached its duties” by not ensuring safe walking conditions, permitting tripping hazards like uneven surfaces and gaps to remain, failing to promptly inspect or remedy dangerous conditions, and not adequately warning guests of those hazards.
Smith further alleges that she sustained permanent bodily injury, along with physical pain, mental anguish, disability, diminished enjoyment of life, and an aggravation of a pre-existing condition, among other related impacts.
How Disney Typically Responds to Lawsuits
Disney usually responds to lawsuits like this through formal legal filings rather than public statements. In most cases, the company does not comment publicly on pending litigation and instead addresses the claims in court.
Disney often files an initial response that may include denying the allegations, asserting that it exercised reasonable care, or arguing that the condition was open and obvious to guests. In trip and fall cases, Disney often argues that it did not know, and reasonably could not have known, about the alleged hazard. The company may also claim comparative negligence, meaning it contends that the guest’s own actions may have played a role in the incident.
Many of these cases are settled, dismissed, or resolved through legal motions before they ever reach trial. If a case does move forward, Disney typically defends its safety and maintenance practices in court using evidence and testimony, rather than making public statements about the situation.

Just looking for a payout ! Everyone knows about those tracks and unless you are blind they are very visible.
100% agree
Oh my goodness. That’s why our courts system is so flawed. Greedy lawyers and unethical people who don’t have the sense to pay attention to what they are doing. Bogus charges. Shame on you!
Lol how many years have thry been there and no one’s gotten hurt 😅 everyone knows they are there everyone knows there’s a train and where there’s a fin train there are tracks. 1 person to spoil it for millions of others. Greed at its finest
I wish these companies could and would countersue. If people thought for one second, their frivolous lawsuit would cost them everything, the court systems may start clearing up.
Definitely trying to get a quick pay day. If she actually suffered a permanent injury, she would be going after a whole lot more money. Also, mental anguish? Why, because she got embarrassed because she can’t watch where she walks?
Another ignorant fool looking for a payout. We need tort reform. Loser pays everything.
Tracks are very visible even at night. Tracks are even shown on the park maps. I have tripped on these while getting photos, because I was not paying attention to what I was doing. A simple trip causing $50,000 dollars, really, lets get real, this is a scam. Millions of people cross these everyday for many years. How many permanent injuries in all those years and all those people ? 1. From one person that just wants a big payout.
I’m sorry you made it all the way up main street and then fell. No money for being a klutz and not paying attention.
So this person was more ignorant than the 50 million+ visitors before her who noted that there were trolley tracks permanently embedded in the pavement since 1971. And this is why we have such a complicated legal system, and why we have “this bag is not a toy” imprinted on plastic bags….
Her negligence for choosing to walk in the street and failing to use the sidewalks provided.
She clearly was trying to get ahead of others. There is no need to walk down the middle of the street. I hope Disney bans her for life…..for her own safety…
