Guest Suing Disney for Damages Over Alleged Fall Injury
A guest has filed a new complaint in Orange County, Florida, against Walt Disney Parks and Resorts, that is seeking damages exceeding $50,000.
According to the complaint, the incident occurred on November 27, 2024, on the property of City Works Eatery and Pour House, which the lawsuit names Disney as the owner and operator of. City Works Eatery and Pour House is located near the western edge of Disney Springs.

According to the filing, the plaintiff was crossing a designated crossing area in a wheelchair when a wheel became stuck in a hole in the asphalt. The plaintiff alleges that they were thrown from the wheelchair, which they claim resulted in two broken bones in their left leg. The complaint argues the hole constituted an unreasonably dangerous condition on the property.
The complaint brings a single count of premises liability, alleging that Disney failed to adequately inspect the area, address the hazardous condition, or provide sufficient warning to guests before the incident. Premises liability is a legal theory that holds property owners and operators responsible for injuries that occur due to unsafe conditions on their property.
The plaintiff is seeking damages for a range of alleged losses, including permanent bodily injury, pain and suffering, disability, disfigurement, mental anguish, loss of enjoyment of life, aggravation of a preexisting condition, medical expenses, lost wages, diminished earning capacity, and anticipated future losses. The complaint also demands a jury trial and requests that the court enter a judgment awarding damages against Disney.

Lawsuit Follows Viral Trolley Track Case
This lawsuit follows a previous case filed against Walt Disney Parks and Resorts in December 2025. This previous lawsuit claimed that the trolley tracks do not “adequately have marked steel rails and flangeways near a castle attraction,” which caused her to trip and fall, resulting in “permanent injuries and substantial medical expenses.”
In this complaint, Rhonda Smith alleged that Disney failed to uphold its responsibility to maintain reasonably safe walkways for guests. She claimed the company allowed hazardous conditions, including uneven surfaces and gaps that could pose a tripping risk, to remain in place. The filing also asserted that Disney did not conduct adequate inspections, correct the alleged dangers in a timely manner, or provide sufficient warnings about the condition.
In its formal response to the trolley track lawsuit, Disney argued that the tracks were an “open and obvious” condition and therefore did not require additional warnings. Disney maintains that because the tracks were plainly visible, it had no legal obligation to provide signage or further notice. The company has requested that the case be decided by a jury, and court records currently list a trial date of November 22, 2027, at the Orange County Courthouse.
Like the trolley track case, Disney could likely respond to the Disney Springs lawsuit by arguing that it was not negligent and that the guest may share some responsibility for what happened. If the case goes to trial, a jury would decide whether Disney is legally at fault and, if so, how much compensation should be awarded. However, many cases like this are settled before trial, so it is tricky to know in advance how it will ultimately be resolved.
